Welcome to PrankPortal ("Service," "Platform," "we," "us," or "our"), accessible at prankportal.com and operated by Infinium Cloud.

PrankPortal is an AI-powered entertainment platform that places automated voice calls ("prank calls") to phone numbers provided by registered users. These Terms and Conditions ("Terms") govern your access to and use of the Service. Please read them carefully.

1. Acceptance of Terms

By creating an account, signing in with Google, or otherwise accessing or using PrankPortal, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

You represent that you are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) and have the legal capacity to enter into these Terms.

2. Description of the Service

PrankPortal allows authenticated users to:

1. Select a pre-built prank scenario or write a custom scenario;
2. Provide a target recipient's name and phone number;
3. Initiate an AI-generated voice call to the recipient on the user's behalf.

All calls are placed by an artificial intelligence voice agent. No human operator speaks during the call. Call transcripts are generated automatically and made available to the initiating user after the call concludes.

The free tier provides up to 1 calls per day per user account. We reserve the right to change usage limits, pricing, or available features at any time with or without notice.

3. AI and Phone Call Disclosures

You acknowledge and agree that:

• All calls are generated and conducted entirely by artificial intelligence. The AI agent operates autonomously during the call. While we program safety guardrails and scenario guidelines, we cannot guarantee that the AI will follow every instruction precisely or that call content will match your expectations exactly.
• The AI may deviate from the selected scenario, improvise, or respond unpredictably to the recipient's reactions. PrankPortal is not responsible for the specific words, tone, or content produced by the AI during any call.
• Calls are designed to end with a friendly reveal disclosing the prank nature of the call. However, the recipient may hang up or otherwise terminate the call before the reveal occurs.
• Calls may be recorded. Audio recordings of calls may be captured and stored for transcript generation, quality assurance, safety monitoring, and abuse investigation. By using the Service, you consent to the recording of calls you initiate. You are solely responsible for complying with any applicable recording consent laws in the recipient's jurisdiction (including two-party consent states).
• Text-based transcripts are generated from speech-to-text processing and may contain inaccuracies.

4. User Responsibilities and Representations

By initiating a prank call through PrankPortal, you represent and warrant that:

1. You personally know the recipient and have a good-faith belief that the recipient will receive the call in the spirit of humor and entertainment;
2. You have obtained any consent required by applicable law before placing a call to the recipient, including but not limited to consent under the Telephone Consumer Protection Act (TCPA), Canada's Anti-Spam Legislation (CASL), and any state, provincial, or local regulations governing automated or AI-generated calls;
3. The recipient is not a minor (under 18 years of age);
4. You are not using the Service to harass, threaten, stalk, intimidate, or cause harm to any person;
5. All information you provide (including phone numbers and context) is accurate and truthful;
6. You understand and consent to calls being audio recorded for transcript generation and safety monitoring, and you are solely responsible for compliance with recording consent laws in the recipient's jurisdiction;
7. You are solely responsible for all consequences arising from calls you initiate, including any legal liability, claims, or damages. PrankPortal provides the technology at your direction — you are the initiator and bear full legal responsibility for each call.

5. Prohibited Uses

You agree not to use PrankPortal to:

• Harass, bully, threaten, or intimidate any person, or engage in any conduct that a reasonable person would consider abusive;
• Impersonate law enforcement, government officials, medical professionals, debt collectors, court officers, or any other authority figure — whether through custom scenarios or by manipulating template prompts;
• Place calls to minors (persons under 18 years of age);
• Place calls to emergency services (e.g., 911, 112), crisis hotlines, or premium-rate numbers;
• Use the Service in any jurisdiction where AI-generated or automated phone calls are prohibited or restricted without having obtained all required consents and authorizations;
• Solicit personal, financial, or sensitive information from the recipient (e.g., Social Security numbers, credit card numbers, passwords, bank account details);
• Create scenarios involving false emergencies, threats of violence, bomb threats, kidnapping, or any claim designed to cause panic or fear;
• Use the Service for commercial solicitation, telemarketing, political campaigns, debt collection, or any purpose other than personal, non-commercial entertainment;
• Circumvent usage limits by creating multiple accounts, using automated scripts, or exploiting technical vulnerabilities;
• Violate any applicable local, state, provincial, national, or international law or regulation.

We enforce automated safety rules on every call (including blocking impersonation of officials and automatic de-escalation when distress is detected), but these safeguards are not infallible. You remain solely responsible for ensuring your use of the Service is lawful and appropriate.

6. Telecommunications and Regulatory Compliance

PrankPortal currently supports calls to United States and Canadian phone numbers only. You acknowledge and agree to the following:

• TCPA (United States): The Telephone Consumer Protection Act and its implementing regulations restrict automated and AI-generated calls. You, as the initiator of each call, are solely responsible for ensuring that you have obtained prior express consent from the recipient as required by TCPA before placing each call. PrankPortal acts as a tool at your direction; by initiating a call, you represent that you have the legal right to do so. You agree to fully indemnify and hold harmless Infinium Cloud against any TCPA claims, fines, penalties, or damages arising from calls you initiate.
• CASL (Canada): Canada's Anti-Spam Legislation regulates commercial electronic messages and certain telecommunications. You represent that your use of PrankPortal complies with all applicable CASL provisions.
• State and Provincial Laws: Many U.S. states and Canadian provinces have additional laws governing automated calls, call recording, and consent requirements. Several states require all-party consent for call recording (including but not limited to California, Florida, Illinois, Pennsylvania, Washington, and Maryland). You are solely responsible for understanding and complying with all applicable laws in the recipient's jurisdiction before initiating a call.
• FCC and CRTC Regulations: You agree not to use the Service in any manner that violates regulations issued by the Federal Communications Commission (FCC) or the Canadian Radio-television and Telecommunications Commission (CRTC).
• Do Not Call List: PrankPortal maintains its own Do Not Call list. Any person may add their phone number to this list to opt out of receiving prank calls through our platform. Calls to numbers on this list will be automatically blocked. You acknowledge that even if you initiate a call to a number on our Do Not Call list, the call will not be placed.

7. Limitation of Liability and Disclaimer of Warranties

7.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI-generated calls will perform exactly as described, scripted, or expected. We do not warrant that safety mechanisms will prevent all harmful content.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PRANKPORTAL, ITS OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY;
• PERSONAL INJURY, EMOTIONAL DISTRESS, OR REPUTATIONAL HARM TO YOU, THE CALL RECIPIENT, OR ANY THIRD PARTY ARISING FROM OR RELATED TO A PRANK CALL;
• DAMAGES ARISING FROM THE RECIPIENT'S REACTION TO, INTERPRETATION OF, OR RESPONSE TO ANY CALL PLACED THROUGH THE SERVICE;
• LEGAL CLAIMS, FINES, PENALTIES, OR REGULATORY ACTION BROUGHT AGAINST YOU AS A RESULT OF YOUR USE OF THE SERVICE.

IN ANY EVENT, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).

8. Indemnification

You agree to indemnify, defend, and hold harmless PrankPortal, its operators, affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

1. Your use of the Service, including any prank calls you initiate;
2. Your violation of these Terms;
3. Your violation of any applicable law, rule, or regulation;
4. Any claim by a call recipient or third party arising from a call you initiated;
5. Your failure to obtain required consent before placing a call.

9. Data Handling and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points regarding data handling:

9.1 Account Data

When you sign in with Google, we receive and store your name, email address, and profile photo from Google. We also collect and store the phone number you provide during account setup.

9.2 Recipient Phone Numbers

Phone numbers you submit for prank call recipients are stored securely in our database for abuse prevention, rate limiting, legal compliance, and service operations. The number is also transmitted to our telephony provider to place the call.

9.3 Call Recordings and Transcripts

Audio recordings of calls may be captured and stored by our telephony provider for transcript generation, quality assurance, and safety monitoring. Text-based transcripts are generated automatically and stored in association with your account. Transcripts are viewable only by you. Recordings and transcripts may be retained for a reasonable period for abuse investigation and legal compliance, after which they may be deleted.

9.4 Usage Data

We collect IP addresses, usage timestamps, and call metadata (duration, status, cost) for security, rate limiting, and service improvement. We log application events for operational monitoring.

9.5 Third-Party Processors

To provide the Service, we share data with third-party processors including:

• Telephony and AI voice agent provider — receives recipient phone number, scenario instructions, and produces call transcripts;
• Voice synthesis provider — receives text to be spoken during calls;
• AI language model provider — powers the AI agent's conversational logic;
• Authentication provider — handles OAuth sign-in.

Each processor is subject to its own privacy policy and data handling practices. We encourage you to review their respective terms.

10. Account Suspension and Termination

We reserve the right to suspend, restrict, or permanently terminate your account and access to the Service, at our sole discretion, without prior notice, for any reason including but not limited to:

• Violation of these Terms or any applicable law;
• Reports of harassment, distress, or harm from call recipients;
• Repeated attempts to circumvent safety guardrails or usage limits;
• Suspicious or fraudulent activity;
• Any use that we reasonably determine poses a risk to the safety or wellbeing of any person or to the reputation or operation of the Service.

Upon termination, your right to use the Service ceases immediately. We may retain data as required by law or for legitimate operational purposes (e.g., abuse records, legal hold). We are not obligated to provide notice, a reason, or an appeal process for account actions, although we may do so at our discretion.

11. Intellectual Property

All content, branding, software, and technology comprising the Service (excluding user-submitted content) are owned by or licensed to PrankPortal and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of any custom scenario text you create. By submitting content to the Service, you grant PrankPortal a non-exclusive, royalty-free, worldwide license to use, process, and transmit that content solely for the purpose of providing the Service.

11.1 Community Content and Public Sharing

When you voluntarily share a prank call to the PrankPortal Community page or make any content publicly available through the Service, you understand and agree to the following:

• Your shared call recording, transcript, and any generated video become publicly accessible to all users and visitors of the Service.
• By making content public, you grant a non-exclusive, royalty-free, worldwide, irrevocable license to PrankPortal, its users, and any third party to view, listen to, download, share, embed, remix, and otherwise use the publicly shared content for any lawful purpose — including but not limited to social media posts, content creation, compilations, commentary, and entertainment — provided that either (a) the PrankPortal watermark present on auto-generated videos is retained, or (b) credit is given to prankportal.com as the source.
• Once you publish content publicly, you waive any right to file claims, complaints, or takedown requests against other users or third parties who use, download, or redistribute your publicly shared content in accordance with this license. You acknowledge that publicly shared content may be copied, saved, or redistributed beyond PrankPortal's control, and that making content public is a voluntary and informed choice.
• You may remove your content from the Community page at any time by revoking the public share. However, removal does not affect any rights already granted to persons who accessed the content while it was publicly available.
• PrankPortal may generate videos from your shared call content, which will include an auto-generated watermark. These videos are made available for download by you and by other users under the same licensing terms described above.

In summary: if you share a prank to the community, anyone can use it as long as the PrankPortal watermark is visible or credit to prankportal.com is provided. If you do not wish for your content to be publicly used, do not share it to the Community page.

12. Third-Party Services

The Service integrates with and depends upon third-party platforms. We are not responsible for the availability, performance, accuracy, or policies of any third-party service. Outages, changes, or discontinuation of third-party services may affect PrankPortal's functionality without liability to you.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the state and federal courts located in the State of Delaware. You consent to the personal jurisdiction of such courts and waive any objections based on venue or inconvenient forum.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and may provide additional notice (such as a banner on the Service or an email to your registered address). Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and PrankPortal with respect to the Service and supersede all prior agreements, representations, and understandings.
